These terms govern your use of fleetfax.com and the fleetfax browser extension (together, "fleetfax"). By using fleetfax, you agree to them.
1. What fleetfax is. fleetfax presents information about motor carriers drawn from public federal records (FMCSA and related Department of Transportation datasets), together with fleetfax's own estimates, which are clearly labeled as estimates. fleetfax describes what those records contain. It does not tell you whether to do business with anyone, and it is not legal, insurance, or business advice. fleetfax is not a motor carrier safety auditor, compliance certifier, broker, or insurer, and it does not recommend, endorse, certify, or advise for or against booking, dispatching, or contracting with any carrier. It does not certify any carrier's safety or regulatory compliance. Verdicts, flags, and summaries are editorial descriptions of public data, and the judgment about any carrier is yours. For every carrier you use, you keep sole responsibility for independent safety verification, insurance checks, and regulatory compliance.
2. The free service. Carrier reports on fleetfax are free and do not require an account.
3. Accounts. Some features require a free account (sign-in is by email link; we never store a password). You are responsible for the email address on your account and for keeping access to it secure. One account per person. You may delete your account at any time from your account page; deletion removes your saved lists and notes, and removes your email address from our records. We retain records of past payments as required for accounting.
4. Paid subscriptions. A free account carries its own features at no charge, within the caps stated on the pricing page: your book of carriers read against the federal record every day, same-day watch on up to 3 carriers that you select, carrier sourcing, your own policy checks, notes, pins, and your do-not-use list. When paid plans open, they add time, scale, and proactivity on top of that: the full dated change timeline with field-level differences, alerts beyond the free caps, bulk and cross-carrier vetting, the connections explorer, and exportable time-stamped records of what you vetted, as described on the pricing page. If the pricing page marks a plan or feature as not yet available, these terms do not promise it until it is offered there. The price and any launch offer are shown on the pricing page before you subscribe. Subscriptions renew automatically until cancelled. You can cancel at any time from your account; your plan stays active until the end of the period you paid for, and we do not charge again after that. We do not issue refunds for partial billing periods, but if something went wrong, contact [email protected] and we will try to make it right. A free trial, where offered, requires no payment method and ends automatically; one trial per person.
5. Your content. Notes, tags, and lists you create are yours. We store them to provide the service, we do not sell them, and we do not use them for anything other than operating your account.
6. Our property. fleetfax and everything that makes it up, including the software, the site design, the fleetfax name and mark, and the derived signals, models, and databases we build from the public records, belong to fleetfax LLC or its licensors. The underlying federal records are public and are not ours. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use fleetfax for your own business, subject to these terms. No other rights are granted.
7. Acceptable use. You may not: resell, redistribute, or republish fleetfax data or reports as a product; scrape, crawl, or bulk-harvest the service; circumvent rate limits, plan limits, or access controls; share account credentials; or use fleetfax, or any data, contact information, or reports from it, to harass, threaten, extort, or defame a motor carrier, a driver, or anyone else. You may not use fleetfax, or data from it, in an automated life-safety system or a real-time dispatch system where a data error, delay, or outage could contribute to injury or property damage. We may suspend or close accounts that do these things. Where export is offered, exported files are watermarked to the exporting account.
8. Accuracy and availability. fleetfax reflects the public records as we last ingested them, and those records contain errors, gaps, and delays that originate with the source. The government and third-party systems we read change, go down, and publish late without notice, and none of that is within our control. Changes generally appear on fleetfax within a day of appearing in the federal data, but we do not guarantee freshness, completeness, accuracy, or uninterrupted availability, and we are not liable for delays, outages, or errors in government or third-party data. fleetfax's own derived signals, including peer estimates, connection findings, and crash rates computed from self-reported mileage, are models, not official government scores, and can be wrong or incomplete. If you believe something on a carrier report is wrong, you can flag it from the report's "Report a data error" link and we will review it.
THE SERVICE AND ALL DATA ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, fleetfax DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTY THAT THE DATA IS ACCURATE, CURRENT, OR COMPLETE.
9. Not a consumer report. fleetfax reports on businesses (motor carriers) using public records. fleetfax is not a consumer reporting agency, fleetfax reports are not consumer reports as defined by the Fair Credit Reporting Act, and you may not use fleetfax to make decisions about consumers' employment, credit, insurance eligibility, or housing.
10. Liability. To the maximum extent the law allows, fleetfax's total liability for any claim arising out of or relating to the service or the data, whether in contract, tort (including negligence), or otherwise, is limited to the greater of one hundred dollars ($100) or the amount you paid us in the twelve months before the claim, and fleetfax is not liable for indirect, incidental, or consequential damages, including business decisions made using the service. In particular, and without limiting the above, fleetfax is not liable for your selection, hiring, or retention of any motor carrier or broker; for cargo loss, damage, delay, or theft; or for personal injury, property damage, or death arising from the acts or omissions of any motor carrier, broker, or driver.
11. Indemnification. You agree to defend, indemnify, and hold harmless fleetfax and its members, officers, and employees from any third-party claim, loss, damage, liability, or expense, including reasonable attorneys' fees, arising out of your use of the service or the data, the business decisions you make with it, or your breach of these terms.
12. Governing law and disputes. These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to the service, the data, or these terms must be brought in the state or federal courts located in Sacramento County, California, and you and fleetfax each consent to the exclusive jurisdiction of those courts. Disputes may be brought only in each party's individual capacity: you and fleetfax each waive the right to participate in any class, collective, or representative action to the fullest extent the law allows.
13. Changes. We may update these terms; if a change is material we will note it on this page and, for account holders, by email. Continuing to use fleetfax after a change takes effect means you accept it.
14. No waiver. If we do not enforce a provision of these terms right away, we are not giving up the right to enforce it later.
15. Severability. If any provision of these terms is held invalid or unenforceable, that provision is severed and the rest stays in full force and effect.
16. Survival. The parts of these terms that by their nature continue to apply, including the accuracy disclaimers, the liability limits, the indemnity, our property, the not-a-consumer-report section, the acceptable-use limits on data you obtained from fleetfax, and governing law and disputes, survive after you stop using fleetfax or delete your account.
17. Entire agreement. These terms, with the privacy policy, are the entire agreement between you and fleetfax about the service, and they supersede any prior or contemporaneous statement, pitch, email, or marketing material.
